High Court flags ‘mischief’ in treating ordinary cash as drug money

The Punjab and Haryana High Court ruled that possessing cash alongside drugs doesn’t automatically equate to “drug money” or “financing illicit traffic” under the NDPS Act. The court criticized police for misusing Section 27-A, which carries severe penalties, and clarified that illicit financing requires evidence of involvement in the drug trade’s financial network, not just the presence of cash.
