The NCLAT has overturned the CCI’s directive preventing WhatsApp from sharing user data with Meta for advertising. While the penalty of Rs 213.14 crore remains, the tribunal set aside the finding of Meta abusing its dominant position in the OTT messaging market. The NCLAT also lifted the ban on data sharing and the requirement for specifying data collection purposes.
